Furthermore, Ivy appealed to Marshal to halt organizing for any execution dates until the review process is complete.

The decision for Ivy to request the review of the state's capital punishment was triggered by the uncompleted execution of one inmate (Kenneth Eugene Smith). According to Ivy, law enforcement and prison officials are not responsible for the problems related to the failure of the state to put inmates to death (The Associated Press, 2022). Instead, criminal hijacking and legal tactics are responsible for these challenges (The Associated Press, 2022). Ivy is interested in a fair process that ensures justice for the victims and their families.

Fortunately, John Hamm (Corrections Commissioner) stated that his department is committed to the review process and that it would be done right. He added that everything had been set for their legal strategy for addressing last-minute appeals, which prepares the department for the activities on the execution day. Since 2017, no State has stopped the execution process except Alabama, which prevented the execution process when Ohio stopped the lethal injection of Alva Campbell because employees failed to find the veins (The Associated Press, 2022).

Robert Dunham (Death Penalty Information Center's CEO) concurred with Ivy's statements. However, he suggested the review should be conducted by an outside body, not the state (The Associated Press, 2022). Dunham believed that the Department of Corrections had a bad history of defending its execution failures. As a result, the department could not conduct a comprehensive and fair review process of capital punishment in the state.

Generally, there are problems associated with capital punishment in the state. As a result, the review process is crucial to ensure all victims get justice. Furthermore, botched executions negatively affect the men on a gurney and their friends and families, prison workers, attorneys, and ministers. Again, this justifies the need for the review process.
